1. Introduction

Genuka Pay is a technical payment orchestration service provided by Genuka, a company based in Cameroon. Genuka Pay provides a technical orchestration service for payments. By accessing or using our services, you agree to be bound by these Terms of Service.

2. Definitions

  • Service: The technical platform provided by Genuka Pay.
  • User: Any individual or entity using the platform.
  • Merchant: A user utilizing the service to accept payments from their customers.
  • Payment Provider (PSP): Licensed entities (e.g., MTN, Orange) that process and hold the actual funds.
  • Transaction: A payment request initiated through the Genuka Pay API.

3. Nature of Service

Genuka Pay acts solely as a technical intermediary. Genuka Pay does not hold funds at any time.All funds are processed, held, and settled by our licensed Payment Provider partners. We are not a bank, an electronic money issuer, or a currency exchange service.

4. Access Conditions

To use the Service, you must create an account and provide accurate information. KYC (Know Your Customer) verification is mandatory for live production environments.Genuka Pay reserves the right to suspend any account that does not comply with verification requirements or displays suspicious activity.

5. Merchant Obligations

Merchants agree to comply with all local laws and regulations. You are responsible for the legality of the products or services you sell and for managing relationships and disputes with your end customers.

6. Payments and Transactions

Genuka Pay is not responsible for transaction refusals by operators or payment providers. Settlement delays depend entirely on the policies of the relevant PSP. The transaction statuses displayed on the Genuka Pay dashboard are for informational purposes only.

7. Suspension and Termination

We may suspend or terminate your access to the Service in case of a violation of these terms, suspicious activity, or at the request of competent authorities. You may terminate your account at any time.

8. Limitation of Liability

Genuka Pay shall not be liable for any indirect losses or damages arising from the use of the Service. We are not responsible for service interruptions caused by mobile operators or payment providers.

9. Applicable Law

These terms are governed by the laws of Cameroon. Any disputes shall be subject to the exclusive jurisdiction of the courts in Douala, Cameroon.
